An Act for dividing and enclosing the Open Fields Pasture Grounds Ings and Common or Waste Ground within the Township of East Cottingwith in the East Riding of the County of York, 13 Geo III , c. 56.

 

East Cottingwith Common Petition for a Bill to inclose Bill ordered 19 January 1773, Presented and read 8 March, Committed 12 March, Reported to be ingrossed 23 March, Passed 24 March, Agreed to by the Lords 1 April, Royal Assent 7 April 1773.

 

Several common fields called Hammersfield, Millfield, Outfield, New Pasture and New Landfield, or by other names, of approx. 400 acres; also one stinted pasture or common, of approx. 60 acres; one unenclosed parcel of meadow called The Ings, of approx. 100 acres; also a common or parcel of waste ground, of approx. 400 acres.

 

Whereas Robert Jefferson is seised of a ¼ of the Manor of East Cottingwith; John Dudding is seised of another ¼; Mary Williamson, another ¼; and Ellen Rudderforth, Mary Rudderforth, Ann Rudderforth, and Elizabeth Rudderforth, daughters and co-heirs of Edward Rudderforth, deceased, the remaining ¼.

 

And whereas Christopher Bethell esq. is owner and impropriator of all the great and small tithes of East Cottingwith…

 

And whereas James Cookson, clerk, is vicar of Aughton is entitled to money payments payable out of houses having common rights amounting to £1 6s 8d, and a common right house in East Cottingwith…

 

The commissioners to allot to Christopher Bethell, as owner of the great tithes, 1/7 part of the value…

 

The Act only gives the names of the principals, (the people who sponsored the bill), the full allotment of land was enrolled in the East Riding Register of Deeds, now kept at East Riding Archives and Local Studies Service, The Treasury House, Beverley, under reference AT/121/17.

East Cottingwith First Assessment


I am not 100% sure, but I believe that this assessment was an early Land Tax Assessment. 


Land Tax Assessments were introduced by an Act of 1692, and was administered at local level, but the survival until 1780 was very patchy. The records from 1780 to 1832 have survived in much greater numbers, as duplicates among the County Quarter Sessions records. This is because the Clerks of the Peace in various counties used them to establish men's electoral rights, as from 1780, payment of land tax on freehold property worth £2 or more a year qualified a man to vote. 


The upheaval in land ownership following enclosure would presumeably neccessitate a reassessment, so I believe the East Cottingwith First Assessment document to be such a reassessment following enclosure.

Rent-Charge Payers in 1850

The rent-charge payers in 1850 are listed in an indenture dated 1st April 1850, between the devisees of Sir Christopher Bethell Codrington (i.e. the executors and trustees of his will, the Hon. Arthur Thelluson of Eaton Square, Middlesex, and John Edmund Dowdswell of the Inner Temple, London) of the first part; The Rev. Joseph Dunnington Jefferson of Thicket Priory of the second part; and Sir Henry Mervyn Vavasour of Melbourne Hall (trustee for J.D.J) of the thrird part.


Property: The rectory church and advowson of Ellerton and rent-charge of East Cottingwith. The description lists previous encumbrances, jointures, lease and release, but with redemption clauses, etc. (This suggests that Sir Christopher needed to raise loans from time to time, and he provided his East Riding properties as collateral).


Sir Christopher died 5 Feb 1843, and his will was proved in the Prerogative Court of Canterbury on the 9th May 1843, with probate being granted to Arthur Thelluson and John E. Dowdswell, (a third executor named in the will, Thomas Lord Foley, having renounced).


Sir Christopher having died with debts, his creditors raised a case in the Court of Chancery against his estate, naming Thelluson as the defendant. By a decree of Chancery dated 1st May 1843 the case was referred to the Chapter of the Prerogative Court of Canterbury, and by another decree of Chancery dated 8th Aug 1844 it was decreed that the estates be sold by public auction to satisfy the debts.


At an auction dated 16th and 17th Oct 1844, John Dunnington Jefferson was the highest bidder for lot 28, the rectory and church advowson of Ellerton, the bid being £220. Since the auction Jefferson offered £705 for another lot, lot 27 (which had not sold at auction), the rent-charge for East Cottingwith, which produced £39 6s 8d per annum. The indenture recited the East Cottingwith Enclosure Act of the 13 Geo. III., and then laid out a table of the current payees, and the amounts they paid:
